GPSR Requirements for e-commerce in EU

We're sharing some crucial updates regarding the upcoming implementation of the General Product Safety Regulation (GPSR) in the European Union (EU), including Northern Ireland, under the 
Northern Ireland Protocol.

This regulation, set to take effect on December 13, 2024, marks a significant milestone in ensuring the safety and integrity of non-food consumer products in the EU market.

The above is part of the many posts on Amazon's forum for it's seller members regarding the latest regulation for those selling their products in the EU. Accounts who do not comply to GPSR risk being removed by Amazon. But for those who have not heard about the General Product Safety Regulation (GPSR) in the EU, this may seem like another hurdle to go through when there's already so much on the plate just to sell a product on Amazon EU.

So what is GPSR actually?

The General Product Safety Regulation is a regulation imposed by the European Union in June 2023 to address product safety issues in the EU as more and more products produced across the globe are easily available for sale on the internet. This regulation applies to all non-food product and all kinds of sales channels in the EU.

Products that are exempted from this rule are:

  • Medicine for humans and animals
  • Food
  • Animal feed
  • Living plants and animals
  • Animal products and byproducts
  • Plant protection products (such as pesticides)
  • Airplanes
  • Antiques
  • Transport vehicles for consumers that are operated by a service provider and not the consumer themselves. 

What do Amazon Sellers have to do to be compliant in GPSR?

Amazon Sellers will have to label their products accordingly and make sure that their products are conformed to the various standards set by the European Union, such as the CE Marking on electronic products. 

How to label correctly?

The label on all products should include the information below:

  • Contact details of the company  (if the manufacturer/seller is located in the EU) or EU representative.
  • Address and e-mail address of importer (if suitable), as well as contact details of the importer if address is different from registered address. 
  • Warnings and safety information with regards to the product written in the language of country sold. 
  • Product model, type, identification number and other information that signifies the particular product.
  • CE conformation marking, battery marking, recycling marking and other markings suitable to the product. 

Who requires an EU Representative to be compliant with GSPR?

Companies who are located overseas require a representative based in the EU to be compliant in GPSR. The EU representative (also known as EU-REP or EC-REP) acts as a contact point between the seller and the local authorities. Should there be any questions or requirements from the local authorities, the EU-REP will be in charge of forwarding the questions to the seller, and answering the local authorities in the seller's stead.
